1. Acceptance of these terms

These Terms & Conditions ("Terms") govern your use of the website mrhomez.com and its related pages, tools and forms (the "Website"), operated by Mr. Homez, Mohali, Punjab, India ("Mr. Homez", "we", "us"). By browsing the Website, creating an account, sending an enquiry or posting a property, you agree to these Terms, our Privacy Policy and our Disclaimer. If you do not agree, please do not use the Website.

2. What Mr. Homez does

The Website is an online platform that displays real-estate projects and properties for sale and rent, publishes guides and tools, and passes enquiries to the relevant builder, promoter, agent, owner or Mr. Homez consultant.

All projects and properties on the Website are added by, or from information published by, builders, developers, promoters, channel partners, agents and owners ("Advertisers"). Unless a listing clearly states otherwise, Mr. Homez does not own, build, promote or sell the listed properties, and is not a party to any agreement, booking, payment or dispute between you and an Advertiser. Any transaction is strictly between you and the Advertiser.

3. Eligibility and your account

You must be at least 18 years old and able to enter into a binding contract under Indian law to use the Website. If you register an account, you agree to give accurate details, keep your password confidential and be responsible for activity under your account. Tell us at once if you suspect unauthorised use. We may suspend or close accounts that break these Terms.

4. Listings, content and images

We do not own the content or images in listings. Descriptions, specifications, floor plans, brochures, logos, project names and images belong to the respective Advertisers or other rights holders. Trademarks belong to their owners, and their appearance here does not imply any affiliation with or endorsement of Mr. Homez.

Images are for representation and illustration only and may not be real. They may be artistic impressions, computer-generated renders, brochure pictures, sample-flat or stock photographs, and may not show the actual property, unit, view, fittings or stage of construction.

We do not independently verify every listing and make no representation or warranty that any listing is accurate, complete, current or available. Sizes, configurations, amenities, specifications, possession dates, approvals, RERA numbers and distances are as provided by Advertisers or public sources and may contain errors.

5. Prices and financial information

Prices and all financial details shown on the Website are approximate and indicative. They are supplied by Advertisers or taken from public sources, may exclude taxes and charges such as GST, stamp duty, registration, parking, club membership, maintenance and brokerage, and can change without notice.

We do not give any assurance, warranty or guarantee about any price, rent, return, appreciation, payment plan, loan, EMI or the availability of any unit at a displayed price. Calculators and tools on the Website give estimates only. The final commercial terms are those you agree in writing with the Advertiser.

6. RERA and due diligence

Display of a project on the Website does not guarantee that it is registered under, or complies with, the Real Estate (Regulation and Development) Act, 2016. You are responsible for your own due diligence before any purchase, booking, lease or payment, including verifying the project on the official state RERA website, checking title and approvals, inspecting the property and taking independent legal and financial advice. Nothing on the Website is legal, tax, financial or investment advice.

7. If you post a property or project

If you submit a listing, photo, review or other material ("User Content"), you confirm that:

• you are the owner of the property or are authorised by the owner or promoter to advertise it;
• the information is true, current and not misleading, and you will update or withdraw it when it changes or the property is no longer available;
• you own or have permission to use every image, plan and text you upload, and they do not infringe anyone's rights;
• where the law requires it, the project and you (as promoter or agent) are registered with RERA and your listing complies with the Act and its rules.

You keep ownership of your User Content. You give Mr. Homez a non-exclusive, royalty-free licence to host, display, reformat, crop, watermark and promote it on the Website and in our marketing for as long as the listing is live. We may edit, reject, unpublish or remove any User Content at our discretion, for example if it appears inaccurate, duplicate, unlawful or infringing.

8. Enquiries and communication

When you send an enquiry, request a callback, book a site visit or post a property, you ask us to contact you and you agree that Mr. Homez and the relevant builder, promoter, agent or owner may contact you by phone, SMS, WhatsApp and email about that request and similar properties, even if your number is registered on a Do-Not-Disturb or National Customer Preference Register list. You can ask us to stop at any time. How we handle your details is explained in the Privacy Policy.

9. Acceptable use

You agree not to:

• post false, misleading, duplicate, unlawful, defamatory or infringing content;
• impersonate any person, builder or agent, or misstate your relationship with a property;
• copy, scrape, harvest or republish listings, images or user data by automated or manual means without our written permission;
• send spam or unsolicited promotions through the Website's forms;
• interfere with the Website's security or operation, attempt unauthorised access, or upload malicious code;
• use the Website for any purpose that breaks Indian law.

10. Reviews and ratings

Reviews reflect the opinions of the users who wrote them, not of Mr. Homez. Reviews must be honest, based on real experience and free of abusive or defamatory language. We may moderate, decline or remove reviews.

11. Our intellectual property

The Website's design, layout, software, text written by us, logo and the "Mr. Homez" name are our property or licensed to us and are protected by law. You may view and print pages for personal, non-commercial use. Any other use needs our written permission. This section does not apply to Advertisers' content, which remains theirs.

12. Third-party links and services

The Website may link to or embed third-party websites and services such as developer sites, Google Maps, YouTube and WhatsApp. We do not control them and are not responsible for their content, accuracy or practices. Your use of them is governed by their own terms.

13. No warranties

The Website and everything on it are provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including accuracy, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation.

14. Limitation of liability and indemnity

To the fullest extent permitted by law, Mr. Homez and its owners, employees and partners are not liable for any direct, indirect, incidental or consequential loss arising from your use of the Website, your reliance on any listing, image, price or tool, or your dealings with any Advertiser or other user.

You agree to indemnify Mr. Homez against claims, losses and costs arising from your User Content, your breach of these Terms or your violation of any law or third-party right.

15. Complaints, takedown and grievance officer

If you believe any content on the Website is inaccurate, unlawful or infringes your copyright, trademark or other rights, or you want your own listing or images removed, write to us with (a) the page link, (b) what is wrong and (c) your name and contact details, and for ownership claims, a statement that you are the owner or authorised to act for the owner.

We acknowledge complaints within 24 hours and aim to resolve them within 15 days, in line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

16. Suspension and termination

We may suspend or end your access, remove content or decline service at any time if we believe these Terms have been broken or the Website is being misused. You may stop using the Website and ask us to close your account at any time.

17. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts at Sahibzada Ajit Singh Nagar (Mohali), Punjab have exclusive jurisdiction over any dispute relating to the Website or these Terms.

18. Changes to these terms

We may update these Terms from time to time. The "Last updated" date at the top shows the current version. Continuing to use the Website after a change means you accept the updated Terms.
